HUNTINGTON, WV (HNN) – A Huntington employer has filed suit demanding that St. Mary’s complete the testing of an injured employees blood sample taken in the hospital shortly after the Dec. 29, 2010 accident.

According to the Cabell County Circuit Court filing, the worker fell and injured his back after passing out on the job at Steel of West Virginia. The hospital, the complaint states, took blood samples to test for drugs and alcohol in the worker’s system. However, the suit claims that St. Mary’s has not completed the tests.

“Due to rapid deterioration of blood samples, SWVA wants it done immediately,” the West Virginia Record summation states.

Hon. Judge David Pancake has been assigned the case.
