Tom Goheen Named to Fill Unexpired Term of Qualls

Huntington, WV (HNN) – Although he finished just out of the top seven finishers in the primary election, Dan Goheen will have his chance to serve as a magistrate. Cabell County’s four Circuit Court judges appointed him to fill the unexpired term of Alvie Qualls.
Qualls, who had been under a suspension with pay, died Tuesday morning, June 10, 2008 at his home of natural causes. A recommendation that he be forcibly retired was pending before the West Virginia Supreme Court of Appeals.
Goheen, a graduate of St. Joseph Catholic High School and Marshall University, formerly served as a member of the Huntington Police Civil Service Commission. He will now be trained for the magisterial position and begin work June 22.
Currently, self-employed in the insurance industry, in previous published interviews Goheen stated he would be closely examine plea agreements, including those for first time and repeat drug dealers. He favors stiffer punishment for offenders.
Interestingly, Goheen lost by 240 votes to retired magistrate Patty Verbage-Spence. She has been in poor health and had resigned before the primary after the circuit judges threatened to call for her removal. Although she did not campaign for the office, Verbage-Spence has now stated she will campaign for the position and come out of retirement should she be re-elected.
In any event, should she be elected and her competency questioned, the Herald Dispatch has quoted chief circuit judge Alfred Ferguson as stating that since Goheen finished eighth out of 18 Democratic primary magistrate contenders which would in Ferguson’s opinion put him on the short list of possible appointments.
